Welcome to Bazarium ("Bazarium", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of the Bazarium platform, including our website and mobile application (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you confirm that you meet this requirement.

If you are between 16 and 18 years of age, you may only use the Service with the consent of your parent or legal guardian, who agrees to be bound by these Terms.

2. Nature of the Service

Bazarium is an online platform that enables users to offer, discover, and exchange goods with other users.

Bazarium acts solely as an intermediary hosting service provider within the meaning of applicable laws, including the EU Digital Services Act. Bazarium is not a party to any contract or transaction concluded between users.

• We do not own, buy, sell, or inspect listed items
• We do not guarantee the quality, safety, legality, or accuracy of listings
• All exchanges are conducted solely between users at their own risk

Users are solely responsible for:

• agreeing on terms of exchange
• delivery or meeting arrangements
• verifying the condition and legality of items

3. Account Registration

To access certain features, you must create an account.

You agree to:

• provide accurate and complete information
• keep your information up to date
• keep your login credentials secure

You are responsible for all activities under your account. You must notify us immediately of any unauthorized use.

4. User Content

You retain ownership of any content you submit, including listings, images, and messages ("User Content").

By posting User Content, you grant Bazarium a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content for the operation and promotion of the Service.

You are solely responsible for your User Content and confirm that:

• you have all necessary rights to post it
• it does not violate any laws or third-party rights

5. Prohibited Conduct

You agree not to:

• use the Service for illegal purposes
• post false, misleading, or fraudulent listings
• infringe intellectual property or other rights
• harass, threaten, or abuse other users
• send spam or unsolicited communications
• upload malware or harmful code
• use automated systems (bots, scraping) without permission
• impersonate others
• interfere with the operation or security of the Service

6. Reporting and Illegal Content (DSA Compliance)

Bazarium provides mechanisms to report illegal or inappropriate content.

Upon obtaining actual knowledge of illegal content, we will act without undue delay to remove or disable access to such content in accordance with applicable law.

We reserve the right to:

• review and assess reports
• take appropriate action at our discretion

Users may also block other users.

7. Enforcement and Termination

We may take appropriate measures if there are legitimate grounds, including violations of these Terms or legal obligations. Such measures may include:

• warnings
• removal of content
• temporary suspension
• permanent account termination

We will take such measures in a proportionate manner where required by law.

If you wish to delete your account and associated data, you may submit a request through our Account Removal page.

8. Fees and Future Changes

The Service is currently free of charge unless otherwise stated.

We reserve the right to introduce fees for certain features in the future. Users will be informed in advance of any such changes.

9. Intellectual Property

All platform content (excluding User Content), including software, design, logos, and trademarks, is owned by Bazarium or its licensors and protected by applicable laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available".

To the extent permitted by law, Bazarium does not provide warranties of any kind, whether express or implied, including:

• merchantability
• fitness for a particular purpose
• uninterrupted or error-free operation

11. Limitation of Liability

Nothing in these Terms excludes or limits liability where it cannot be excluded under applicable law, including liability for:

• intent (Vorsatz)
• gross negligence (grobe Fahrlässigkeit)
• injury to life, body, or health

In cases of slight negligence, Bazarium shall only be liable for breaches of essential contractual obligations (Kardinalpflichten), and liability shall be limited to foreseeable damages typical for the contract.

Any further liability is excluded to the extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless Bazarium from any claims, damages, or expenses arising from:

• your use of the Service
• your User Content
• your violation of these Terms or applicable law

13. Third-Party Services

The Service may contain links to third-party services.

Bazarium is not responsible for:

• their content
• their availability
• their practices

Use of third-party services is at your own risk.

14. Disputes Between Users

Bazarium is not responsible for disputes between users.

We may, at our discretion, assist in resolving disputes, but we are not obligated to do so.

15. Consumer Rights

Nothing in these Terms limits any mandatory rights you may have as a consumer under applicable law, including EU and German consumer protection laws.

16. Changes to These Terms

We may update these Terms from time to time.

Users will be informed of material changes. Continued use of the Service after such changes constitutes acceptance of the updated Terms.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany.

If you are a consumer residing in the EU, you may also benefit from mandatory consumer protection provisions of your country of residence.

For disputes:

• If you are a merchant: jurisdiction is Cologne, Germany
• If you are a consumer: statutory jurisdiction rules apply

18. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

19. Privacy

Information on how we process personal data is available in our Privacy Policy.

20. Safety Notice

Users are encouraged to:

• meet in public places when exchanging items
• verify items before completing a swap
• act responsibly and cautiously

Bazarium does not guarantee the safety of any interaction between users.
